Trump delays effective date of travel ban amid court battle

A United States appeals court recently upheld a decision that blocked the executive order signed by President Trump. The only branch of the government that is acting outside its constitutional authority is the judicial branch, not the executive branch. That ruling said the executive order violated USA immigration law. The petition also asked the Supreme Court justices to determine the legality of the executive order. The Trump administration has said it is needed to protect national security.

A new White House memo seeks to keep parts of President Donald Trump's immigration executive order alive, even as its broader implementation remains stalled due to court injunctions.

That 90-day period was about to expire, with some challengers of the ban using the lapsing timetable to reason that the executive order was now moot.

The 4th U.S. Circuit also has called Trump's national security concerns an after-the-fact justification for a policy that was "rooted in religious animus".




"Congress granted the President broad power to deny entry to aliens, but that power is not absolute", Gregory wrote in a ruling that largely upheld the original block on the travel ban.

The court's processing of the Trump Administration's appeals in the two cases has been slowed down a bit because one of the lower court decisions it is now being asked to review just came out on Monday, when the other case was almost finished with the filing of briefs.
