Supreme Court hears same-sex marriage cake case

Protesters rally in front of the Supreme Court building on the day the court is to hear the case Masterpiece Cakeshop v. Colorado Civil Rights Commission Dec. 5, 2017 in Washington, DC. The outcome of the case seemed to rest with the 81-year-old justice, who often finds himself with the decisive vote in cases that otherwise divide the court's conservatives and liberals. According to CNN, while Phillips refused to make Craig and Mullins a wedding cake, he did offer to make them other baked goods. "I would not like to utilize my aesthetic gifts to make something that conflicted with my Christian confidence", he said in a meeting, noticing that he has additionally declined to make cakes to observe Halloween.

Phillips then took his case to the Supreme Court and the justices agreed to take it up after mulling it for several weeks.

After months of heavy lobbying, the Texas Supreme Court eventually decided that the Pidgeon, Hicks, and other taxpayers could block the city from offering spousal benefits to employees in same-sex marriages.

Supreme Court Justice Anthony Kennedy is suggesting skepticism of the arguments of a Colorado baker who defended his refusal to make a wedding cake for a same-sex couple by citing the First Amendment's free speech clause.

Because same-sex marriage was not yet legal in Colorado in 2012, Justice Samuel Alito noted, Craig and Mullins could not have obtained a marriage license where they lived or gotten a local official to marry them.

"A loss at the Supreme Court could open the door to many forms of discrimination that have always been outlawed in our society", TIME reported Mullins said. Kennedy described comments made by one of the seven Colorado commissioners in the case as hostile to religion. She said the Supreme Court's constrained discourse regulation "prohibits the commission from requesting that craftsmen outline custom articulation that passes on thoughts they consider shocking".

LGBT rights advocates expect that if the Supreme Court at last favors Phillips, it will lessen its point of interest assessment from two years prior that made room for same-sex marriage across the country. Kennedy asked the baker's attorney.

On the one hand, Kennedy pointed to photographers, florists, graphic designers and even jewelers who might likewise be able to refuse working on a same-sex wedding if the court rules for Phillips.

More than 20 states have similar laws. While she argued that the free exercise clause forbids the commission from targeting Phillips "and like-minded believers for punishment", she reserved the bulk of her brief for the free speech clause, perhaps targeting Kennedy, who has at times shown an expansive view of free speech.

Not surprisingly, the same sex couple, David Mullins and Charlie Craig, see the case through an entirely different lens: discrimination. "Today's abnegation by the nation's highest court opens the door for an onslaught of challenges to the rights of LGBTQ people at every step".

But Craig and Mullins have argued that a cake is just a cake, and not a form of artistic expression. "We were publicly humiliated for who we were".

"Generally, the bread kitchen looks for a protected appropriate to hang a sign in its shop window announcing, 'Wedding Cakes for Heterosexuals Only, '" the ACLU's David D. Cole wrote in court briefs.

The lawyer replied no, because anti-discrimination laws in Colorado cover race, sex and sexual orientation, but do not protect KKK participants.

A few onlookers and place holders started holding up in line last Friday to secure one of the uncommon seats open to the general population in the lofty court. Phillips' lawyer claims that the baker is an artist and should not be forced to express what the government dictates.
