Laxalt says he was not requested to hitch lawsuit on web neutrality

Washington State Attorney General Bob Ferguson recently filed a petition to appeal the Federal Communications Commission (FCC) decision to rescind net neutrality rules.

"An open Internet - and the free exchange of ideas it allows - is critical to our democratic process", Schneiderman said.

Heitkamp says repealing the net neutrality rules could lead to higher prices for consumers, slower internet traffic, and even blocked websites.

NY attorney general Eric Schneiderman, who is leading the multi-state lawsuit, said it is illegal for the FCC to make "arbitrary and capricious" changes to policies like net neutrality.

A month after the Federal Communications Commission voted to scrap net neutrality rules, 22 states, including ME, are fighting back in court.

The Republican-led FCC voted to overturn the rules last month. Senate Democrats are now calling for one more Republican to join their cause.

The repeal of the net neutrality rules was pushed by FCC Chairman Ajit Pai, a Republican picked by Trump a year ago to lead the agency. He also claimed that the FCC erroneously and unreasonably interpreted the Communications Act, the federal law at the heart of the net neutrality rules. Meaning the fight for net neutrality is going to be a tough one.

Senate Democrats also announced on Tuesday that they are just one vote shy of a majority that would allow them to nullify the FCC's net neutrality rollback, Reuters reported. The regulator will reclassify ISPs as information providers under Title I.

Democrats need a least two Republican votes to pass a repeal in the Senate. In fact, a Washington Post survey found that 83 percent of Americans supported net neutrality.

Under this act, the FCC can not make "arbitrary and capricious" changes to existing policies, such as net neutrality, with the coalition stating the FCC has not justified the Commission's departure from its policy and practice of defending net neutrality.

Hawaii Attorney General Doug Chin spoke with the media in front of a federal courthouse, December 6, in Seattle.

Some states, like California, have been forced to get creative as they propose their own rules. To make its case, the FCC was required to produce a huge volume of work that comprehensively documented why it believed its net neutrality proposals and guidelines were the appropriate solution to various problems.

In Tuesday's filing, the attorneys general requested that the U.S. Court of Appeals for the D.C. Circuit review the FCC's new policy to determine whether it is illegal and unconstitutional.
